A 16-year-old Chicago girl, Ofelia Giselle Torres Hidalgo, has died from an aggressive cancer just days after an immigration judge ruled her father could stay in the United States. Ofelia had spent months fighting for his release while undergoing treatment for stage 4 alveolar rhabdomyosarcoma.

Ofelia was diagnosed with the rare and fast-growing cancer in December 2024. She endured chemotherapy and radiation, but her condition worsened under the stress of her father's detention. In October, she attended his immigration hearing in a wheelchair, her lawyers noting she had paused treatment due to the emotional toll.

Her father, Ruben Torres Maldonado, was arrested on 18 October 2024 during Operation Midway Blitz, an immigration enforcement sweep at a Home Depot in suburban Chicago. A painter and renovator, he had lived in the United States since 2003 and had three American-born children, including Ofelia and her younger brother. His attorneys argued his detention was unlawful, and a judge later ordered a bond hearing, citing due process violations.

Three days before Ofelia's death, the immigration judge granted Maldonado cancellation of removal—a relief allowing him to stay in the country. The ruling recognized the extreme hardship his deportation would cause his United States citizen children. It also opened a path to permanent residency and, eventually, citizenship.

In a GoFundMe video recorded during her treatment, Ofelia had pleaded for her father's release. She described the situation as unfair to immigrant families who worked hard and contributed to their communities. Last week, too ill to attend in person, she joined his final hearing via Zoom.

The judge's decision ensures Ruben Torres Maldonado can remain with his family in the United States. His case now moves toward permanent legal status, though the process will take time. Ofelia's death leaves her family without the daughter and sister who fought publicly for her father's right to stay.
